▪ GENERAL TERMS AND CONDITIONS OF SALE AND USE JEUNE AFRIQUE BUSINESS+

The publication JEUNE AFRIQUE BUSINESS+ is the exclusive property of the company JEUNE AFRIQUE MEDIA GROUP. All of its contents are protected by French and international laws relating to copyright and intellectual property. Individual subscriptions (hereinafter “Subscriptions”) or multi-user licenses (hereinafter “Licenses”) do not entail any transfer of ownership rights of any kind to the Customer (the term “Customer” refers to any user or administrator of a Subscription or License).
METHODS OF DISTRIBUTION
JEUNE AFRIQUE BUSINESS+ content can be viewed under one of the following subscription plans:
Individual Subscriptions – Individual Subscriptions are strictly personal. To view publications and access online services, Subscribers are required to provide a personal e-mail address (e.g. firstname.lastname@example.org). Content may not be shared in any way, either within or outside an organization. It may not be distributed by e-mail, nor on an intranet or extranet, nor reproduced on a blog or on social networks. Subscriptions are available in only one language, either French or English. The choice of language is made at the time of subscription and cannot be changed.
Multi-User Licenses – Multi-User Licenses (for 2 or more users) allow collective subscriptions within the same legal structure to be managed via a single invoice. They offer advantageous graduated discounts, but require Customers to comply with the same intellectual property rules as individual Subscriptions. The content of JEUNE AFRIQUE BUSINESS+ can be accessed in French or in English, at the user’s choice. There are two types of Licenses:
– Named Licenses are intended for the exclusive use of the Subscribers in whose name they were purchased and to whom they are addressed. To view publications and access online services, Subscribers are required to provide a personal e-mail address (e.g. email@example.com).
– Collective Licenses are addressed to a set of readers who belong to the same legal structure, but who are not identified by name. To view publications and access online services, Subscribers have a collective e-mail address (ex: firstname.lastname@example.org).
RESTRICTIONS ON EXTRACTION AND INDEXING
Under Article L342-1 of Law No. 98-536 of 1 July 1998 of the French Intellectual Property Code (transposing Directive 96/9/EC of 11 March 1996), JEUNE AFRIQUE MEDIA GROUP prohibits “the extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of JEUNE AFRIQUE BUSINESS+ onto another medium, by any means and in any form whatsoever.”
In practice, the use of robots to extract a substantial part of the content of JEUNE AFRIQUE BUSINESS+ is prohibited, unless written permission is obtained.
RESPONSIBILITIES OF AUTHORIZED READERS
Regardless of the chosen subscription plan, only one private copy is authorized for each user.
Readers authorized under a Subscription or License agreement may print out an article, but may under no circumstances distribute it to third parties, including within their own company (whether by e-mail, intranet or hard copy). The dissemination on social networks of articles published on the JEUNE AFRIQUE BUSINESS+ website is strictly prohibited, except in the case of a quotation.
Authorized readers undertake to keep their passwords secret and not to disclose them in any form whatsoever to third parties.
RESPONSIBILITIES OF LICENSE ADMINISTRATORS
Administrators in charge of managing a License are responsible for ensuring the acceptance of and compliance with these General Terms and Conditions of Sale and Use by all of the readers authorized under the said License.
ORDERING AND MANAGING SUBSCRIPTIONS AND LICENSES
Any order for a Subscription or License implies full and unconditional acceptance of these General Terms and Conditions of Sale and Use.
Start date – In the case of new subscriptions, the Subscription or License takes effect upon receipt of the duly validated order. In the case of renewals, the new Subscription or License takes effect on the expiry of the previous Subscription or License. Any other arrangements (retroactive subscription, starting on a specific date, etc.) must be specified at the time of ordering.
Cancellation – Subscription and License orders are considered firm and definitive from the moment of their reception by JEUNE AFRIQUE MEDIA GROUP. Under the prevailing legal provisions, Customers may exercise their right of withdrawal during the 14-day period following the order. However, the Customer shall be liable for an amount, calculated on a pro-rata basis, corresponding to the length of the Subscription or License period elapsing between the registration of the order and its cancellation.
Automatic renewal – By opting for automatic renewal, Subscribers benefit from a 5% discount on the basic rate each year. Six weeks before the expiry date, Subscribers are sent an invoice for a one-year subscription renewal. If they do not wish to renew, they have only to return the invoice, bearing the instruction “Cancel”, within six weeks following the invoice date. Beyond this deadline, no cancellations will be accepted; the Subscription or License will be deemed to have been renewed, and the corresponding amount will be due in full.
PAYMENT TERMS AND CONDITIONS
An invoice for the amount of the Subscription or License is issued at the time the service is initiated. It is sent electronically, in PDF format, by the account manager to the Customer (or to the billing contact designated by the Customer when placing the order). Requests for invoices should be addressed to email@example.com.
Terms of payment – Payment for the Subscription or License is due upon receipt of the invoice, and must be made within a maximum period of 30 days thereafter. In the event of late payment, the Subscription or License will be suspended until payment of the full amount of the invoice has been received.
Means of payment – JEUNE AFRIQUE MEDIA GROUP accepts payments in euros (EUR), made by the following means:
- Bank check payable to JEUNE AFRIQUE MEDIA GROUP;
- Bank transfer. Any bank transfer fees levied by the Customer’s bank shall be borne by the Customer.

PERSONAL DATA AND PRIVACY
JEUNE AFRIQUE MEDIA GROUP complies strictly with the laws in force on the protection of privacy and personal liberties, and in particular with the General Data Protection Regulations (GDPR) which entered into force in the European Union in May 2018. Only the staff of JEUNE AFRIQUE MEDIA GROUP, who are subject to strict confidentiality rules, have access to information on customers and prospects. No data processing is outsourced to any third party company. JEUNE AFRIQUE MEDIA GROUP undertakes never to disclose to a third party any information sent to it by Customers (whether Administrators or Readers). In accordance with the French Data Protection Act (Loi informatique et libertés) of 6 January 1978, Customers have the right to access, rectify and oppose the use of their personal data. They can refuse to receive promotional messages by modifying their personal information online or by sending a request to Customer Service (email@example.com).
JEUNE AFRIQUE MEDIA GROUP reserves the right to modify these General Terms and Conditions of Sale and Use at any time.
